Terms of Use and User Agreement

These Terms govern access to and use of the My Classifieds website, services, accounts, advertisements, paid listing products and related features.

1. Operator and acceptance

My Classifieds is owned and operated by SAHIL KOTHARI ENTERPRISES PRIVATE LIMITED, CIN U74999PN2014PTC150594, having its registered office at Vardhaman Capital, Plot No. 13, Gat No. 42/1, Mouje Rui, Taluka Baramati, District Pune, Maharashtra – 413133 (“Company”, “My Classifieds”, “we”, “us” or “our”).

By creating an account, requesting an OTP, posting or responding to an advertisement, purchasing a listing service, clicking “I agree”, or otherwise using My Classifieds, you enter into an electronic contract with the Company and agree to these Terms and the policies incorporated below. If you do not agree, do not use the platform.

Electronic acceptance and records are intended to be valid under section 10A of the Information Technology Act, 2000. We record the policy version, date/time, account, action and reasonable technical acceptance evidence.

2. Incorporated policies

The following form part of these Terms:

• Privacy and Cookies Policy;

• Listing Rules and Prohibited/Restricted Listings Policy;

• Advertiser, Seller and Service-Provider Policy;

• Grievance, Report Abuse and Takedown Policy;

• Paid Listings, Cancellation and Refund Policy;

• Transaction Safety and Platform Disclaimer;

• Intellectual Property Complaint Policy;

• Sponsored Listings and Ranking Disclosure;

• Synthetic and AI-Generated Content Policy; and

• where applicable, Additional Terms for Business Advertisers.

3. Eligibility

You must be at least 18 years old and competent to contract under Indian law. A minor may browse only under the supervision of a parent or lawful guardian but may not register, post, purchase a plan, offer goods/services, apply for a transaction or contact an advertiser through an account.

If you use My Classifieds for a company, firm, trust, society, employer, promoter, broker, dealer or other person, you represent that you are authorised to bind that person. “You” then includes that person.

4. Platform role

My Classifieds provides advertising space, search, discovery, contact and listing-promotion services. Unless expressly stated for a separate service, the Company:

• is not the owner, manufacturer, seller, buyer, landlord, tenant, broker, promoter, employer, recruiter, lender, insurer, auctioneer, transporter or agent for a user;

• does not take possession of listed goods or property;

• is not a party to a user-to-user negotiation, inspection, payment, agreement, employment or transaction;

• does not guarantee identity, title, ownership, authority, legality, quality, safety, condition, price, availability, vacancy, employment, solvency, delivery, return, refund or performance; and

• does not provide legal, financial, investment, tax, medical, employment or technical advice.

OTP verification confirms access to a mobile number at a point in time; it is not identity, title or trust certification.

5. Account and OTP security

Provide accurate, current information. Keep your device, SIM, OTP and account access secure. Do not sell, transfer, share or automate an account; create accounts for another person without authority; evade suspension; or impersonate anyone.

Inform us promptly at `connect@myclassifieds.in` if you suspect unauthorised use. We may rate-limit OTP requests, require reasonable verification, suspend access or preserve records to prevent fraud and comply with law.

6. Posting advertisements

You may post only if you have legal ownership, authority or a lawful interest in the subject of the advertisement. Every advertisement must:

• be true, complete, current and not misleading by statement, omission, image, price or category;

• identify the correct advertiser capacity and, where applicable, business status;

• comply with law, the Listing Rules and category requirements;

• disclose material defects, restrictions, charges, conditions and regulated status;

• use content that you own or are permitted to use;

• avoid personal, financial, identity or sensitive information that should not be public; and

• be promptly corrected, marked unavailable or removed when no longer accurate.

Submitting an advertisement does not create a right to publication. All advertisements may undergo automated and/or human moderation.

7. Contact information and off-platform communication

If contact features are enabled, you choose whether your phone number is publicly displayed or used to create a call/WhatsApp link. This choice must be recorded separately from acceptance of these Terms and may be changed by editing or withdrawing the advertisement.

Communications through telephone, WhatsApp, email or third-party services are also governed by those services’ terms and privacy practices. My Classifieds does not control off-platform messages, payments or conduct. Never share an OTP, UPI PIN, card PIN, password or unnecessary identity document.

8. Listing duration and expiry

Unless the checkout or posting screen states otherwise:

• Free listing: ₹0, displayed for 7 days;

• Paid listing: ₹199, displayed for 7 days;

• Premium listing: ₹499, displayed for 30 days;

• Featured add-on: ₹299, enhanced placement for 10 days for an eligible paid listing.

A paid duration starts when the advertisement is approved and first published, not merely when payment is captured. A listing expires automatically at the end of its duration. We may send a reminder about two days before expiry, but reminder delivery is not guaranteed and does not extend the listing.

No plan auto-renews unless an auto-renewal product is separately introduced and you expressly opt in after seeing the renewal amount, interval and cancellation method.

9. Paid visibility is not endorsement

Paid, Premium, Featured, Sponsored or similar labels concern advertising placement only. They do not mean the user or advertisement is verified, safer, recommended or guaranteed. Payment never overrides moderation or law. Details are in the Ranking Disclosure and Refund Policy.

10. Moderation and enforcement

We may review, hold, request edits, restrict reach, label, reject, suspend, disable or remove an advertisement or account where we reasonably believe it:

• violates these Terms, a policy or law;

• creates a safety, fraud, privacy, intellectual-property or consumer risk;

• is duplicate, spam, miscategorised, expired or technically harmful;

• contains unverifiable regulated claims or required details are missing;

• is subject to a complaint, court order or lawful government intimation; or

• may expose the Company or users to legal or operational harm.

Where appropriate and legally permissible, we will give the affected user the reason and a reasonable opportunity to dispute the decision. Urgent removal, evidence preservation or legal compliance may occur before notice.

11. Synthetic and AI-generated content

Where upload or media features are enabled, you must truthfully declare materially AI-generated or altered audio, visual or audio-visual content. Permissible synthetic content must carry the platform’s prominent label and available provenance metadata. You must not remove or hide a label or create deceptive depictions, false documents, impersonation, non-consensual intimate content or unlawful synthetic content. See the AI Content Policy.

12. User licence to the Company

You retain ownership of content you lawfully own. By submitting content, you grant the Company a non-exclusive, worldwide, royalty-free, sublicensable licence, for the listing and necessary retention period, to host, store, reproduce, format, translate, resize, display, communicate, distribute and technically process it solely to operate, promote, secure and improve My Classifieds, enforce policies and comply with law.

This licence does not authorise the Company to sell your listed goods or use your content for an unrelated endorsement. It ends when no longer reasonably required, subject to backups, legal holds, evidence and statutory retention.

13. Prohibited conduct

You must not:

• breach the Listing Rules or any applicable law;

• scrape, harvest, crawl or bulk-download data without written permission;

• send spam, threats, harassment, malware, phishing or deceptive links;

• manipulate price, ranking, reviews, clicks, location or engagement;

• bypass security, rate limits, moderation, payment or access controls;

• reverse-engineer the service except to the limited extent law does not permit restriction;

• misuse reports, intellectual-property notices or legal processes;

• collect or reuse another user’s personal data for unrelated marketing or unlawful purposes;

• make advance-fee, employment, investment, loan, lottery, courier or payment scams; or

• interfere with platform availability or another person’s rights.

14. Third-party services

The platform may use or link to hosting, maps, OTP, analytics, image, payment, WhatsApp, email and other providers. A link or integration is not an endorsement. Third-party availability and terms apply. The Company remains responsible only to the extent imposed by non-waivable law.

15. Privacy

Personal data is handled under the Privacy and Cookies Policy. Do not upload Aadhaar, PAN, banking credentials, full identity documents, health records or another person’s personal data unless a specific, lawful, secure field expressly requests it. Do not place such data in public advertisement text or images.

16. Intellectual property

My Classifieds branding, software, design, compilation and original platform content are owned by or licensed to the Company. No right is granted except the limited right to use the service under these Terms. Complaints about user content must follow the IP Complaint Policy.

17. Disclaimers

The service is provided on an “as available” basis. We do not promise uninterrupted operation, a particular ranking, enquiries, sale, hire, tenant, customer, response or commercial result. Search results and location/radius information may be incomplete or approximate. Users must conduct independent verification and use the Safety Policy.

Nothing in these Terms excludes a representation or obligation that cannot lawfully be excluded.

18. Limitation of liability

To the maximum extent permitted by law, the Company is not liable for indirect, incidental, special or consequential loss arising from user content, an off-platform transaction, loss of opportunity, fraud by another user, third-party service, or unauthorised conduct that the Company did not cause.

For a claim arising solely from a paid listing service, and only where limitation is legally permissible, the Company’s aggregate contractual liability will not exceed the amount actually paid to the Company for the specific service giving rise to the claim.

These limitations do not apply to fraud or wilful misconduct by the Company, liability that cannot be excluded, or statutory consumer/data rights.

19. Indemnity

If you act in a business, professional or commercial capacity, you will indemnify the Company and its officers against third-party claims, penalties and reasonable costs arising from your unlawful listing, false representation, infringement, regulated activity, transaction, tax/default or breach of these Terms, except to the extent caused by the Company.

A consumer’s liability is limited to what applicable law validly permits.

20. Suspension, termination and deletion

You may request account deletion through the Contact page at /contact or email connect@myclassifieds.in. We may suspend or terminate access for breach, fraud, risk, inactivity, legal requirement or discontinuation. Expiry or termination does not erase accrued rights, payment/invoice records, evidence, legal holds or records that must be retained.

Registration information is retained for at least 180 days after account cancellation/withdrawal as required for intermediary compliance. Details are in the Privacy Policy.

21. Changes

We may update these Terms prospectively. We will display the updated version and effective date, inform users as legally required, and obtain fresh affirmative acceptance for material changes affecting payment, data use or substantive rights. Continued use after a non-material update takes effect constitutes acceptance where law permits.

22. Electronic communications

You consent to service-related electronic communications necessary to operate the account, including OTPs, security alerts, moderation decisions, receipts, expiry notices and policy notices. Marketing communications require a separate optional consent and may be withdrawn.

23. Grievances and disputes

First submit a complaint under the Grievance Policy. Consumers retain all rights to approach a Consumer Commission, the National Consumer Helpline or another competent statutory forum. Persons aggrieved by an intermediary Grievance Officer’s decision or non-resolution may use the Grievance Appellate Committee mechanism within the applicable period.

Parties may voluntarily attempt good-faith negotiation or mediation. This does not suspend a statutory deadline unless law or a written agreement validly provides otherwise.

Subject to non-waivable consumer, data, regulatory and other statutory jurisdiction, these Terms are governed by Indian law and courts having lawful territorial and pecuniary jurisdiction at Baramati/Pune, Maharashtra, will have jurisdiction.

24. General

If a provision is unenforceable, it will be limited or severed without affecting the rest. Failure to enforce once is not a waiver. You may not assign your account or rights without consent. The Company may assign the service to a successor as part of a lawful restructuring or transfer, subject to notice and data-protection law. Force-majeure events may excuse delay to the extent legally permitted but not payment already due or mandatory legal obligations.
